UPON hearing the counsel the Court made the following O R D E R
1 Mr Anupam Lal Das, senior counsel appearing on behalf of the petitioner, submits that there is an award by ICC Paris in favour of the petitioner.
2 In the meantime, it has been submitted that the bank guarantees which were issued by the State Bank of India to the counter party in Ethiopia - Bank of Abyssinia, the second respondent, is likely to be encashed. It has been submitted that there is a clear case of irretrievable in justice in the event the bank guarantees are paid over in Ethiopia.
- 2 Issue notice, returnable on 10 July 2023.
- 3 The interim order which was passed on 10 May 2023 shall continue till 10 July 2023.
