UPON hearing the counsel the Court made the following ORDER

Application seeking permission to file the Special Leave Petition is granted.

  1. Delay condoned.

3. The learned Additional Solicitor General submits that the impugned judgment would affect the operation of the provisions of MMDR Act throughout the country and would have widespread ramifications on other cases similarly situated.

4. Learned Senior counsel – Mr. Mukul Rohtagi for the Respondent No.1, however, states that the State of Rajasthan has already accepted the Judgment passed by the High Court and implemented also.

5. In view of the above statement made by the learned Senior counsel, we are not inclined to interfere with the impugned order passed by the High Court.

6. The Special Leave Petition is, accordingly, dismissed.

7. However, the question of law involved in this case is kept open.

8. Pending applications also stand disposed of.
