The Special Leave Petition is filed by Mr. Sibo Sankar Mishra, Advocate on 23rd May, 2014 against the Judgment and Order dated 6.9.2012 of the High Court of Orissa at Cuttack in W.P.(C) No. 16257 of 2012.

It is submitted for information of the Hon'ble Court that two applications for condonation of delay in filing and refiling the Special leave petition have been filed. There is delay of 534 days in filing the Special Leave Petition and delay of 25 days in refiling the Special Leave Petition.

It is further submitted that SLP(C) No. 18903 of 2014 entitled STATE OF ORRISA AND ORS Vs. KALU SWAIN arising out of similar issue was listed before the Hon'ble Court on 15.7.2014, when the Court directed issue notice and the same is pending before the Hon'ble Court(Copy of the order dated 15.7.2014 enclosed herewith in the SLP's paper books for the kind perusal of the Hon'ble Court).

It is further submitted for information of the Hon'ble Court that SLP(C) No. 13657 of 2012 entitled STATE OF ORISSA & ORS. Vs. PRABIRA KUMAR BISWAL & ORS. Arising out of similar issue was dismissed by this Hon'ble Court on 20.4.2012 . (Copy of the order has been annexed as Annexure P6 placed at Page No. 63 of the SLP paper books for the kind perusal of the Hon'ble Court).

The matter above mentioned is listed before the Hon'ble Court with this Office Report.2
