The matters abovementioned were listed before the Hon'ble Court on

22nd August 2016, when the Court was pleased to pass the following order:

"Delay condoned.

Issue notice.

Dasti, in addition, is also permitted.

Counter affidavit, if any, shall be filed within six weeks.

Rejoinder Affidavit, if any, within four weeks thereafter.

Any additional documents may also be filed during this period.

In the meantime, there shall be stay of the refund of the amount."

It is submitted that Show Cause Notice was issued to the Sole Respondent through Registered Post on 3rd September 2016. M/s. Parekh & Co., Advocate has on 23rd September 2016 filed Vakalatnama/Appearance on behalf of Sole Respondent.

It is further submitted that Counsel for the Sole Respondent has on 17th October 2016 filed Counter Affidavit and an application for permission to bring on record additional and subsequent facts and documents with affidavit. The said application has been registered as I.A. No.4. Paper Books of Counter Affidavit and the application are being circulated herewith for kind perusal of the Hon'ble court.

SLP (CIVIL) NOS.25041 & 25043 OF 2016

It is submitted that Show Cause Notice was issued to the Sole Respondent through Registered Post on 3rd September 2016 in both the matters. As par report of Postal Authorities, show cause notice has been served on Sole Respondent in both the matters on 10th September 2016, but no one has filed Vakalatnama/Appearance so far.
