Mrs. Anil Katiyar,Adv. UPON hearing counsel the Court made the following O R D E R Shri K.T.S.Tulsi, learned senior counsel, made further submissions and concluded his arguments. During the course of hearing, our attention was drawn to the information obtained by Shri Subhash Chandra Agrawal under the 2 Right to Information Act. A perusal of the list enclosed with the information made available by the President's Secretariat on June 2, 2011 shows that as many as 17 Mercy Petitions were processed and submitted by the Ministry of Home Affairs to the President's Secretariat between 13.04.2005 and 27.05.2011. The list also shows that 11 Mercy Petitions received by the President's Secretariat from the Ministry of Home Affairs between 03.11.2009 to 13.05.2011
were decided on various dates between 18.11.2009 and 25.05.2011.
Keeping in view the importance of the issue arising in the writ petition and the fact that a large number of other persons may not be, due to sheer ignorance able to file petition under Articles 72 or 161 of the Constitution or move the Court as has been done by the petitioner in this case, we request Shri Ram Jethmalani and Shri T.R.Andhyarujina, learned senior counsels of this Court to assist us as amicus. Both Shri Ram Jethmalani and Shri T.R.Andhyarujina have graciously accepted our request.
Learned Additional Solicitor General requests for four weeks' time to place before the Court the compilation containing details of various Mercy Petitions received by the Government of India and the Governments of different States and their status as on the date of preparation of the compilation. The copies of the compilation be made available to the counsel assisting Shri Ram Jethmalani and Shri T.R.Andhyarujina by 16.12.2011.
For further arguments, the case be listed on 11.01.2012.
