UPON hearing counsel the Court made the following O R D E R

Ms. Hemantika Wahi, learned counsel has raised the question involved in the first case i.e. SLP(C)No.37240-37241/2013 as to whether the person seeking employment on compassionate ground can ask the Government to make a reference or the Labour Court would competent to decide to the issue, as she has submitted that the person seeking job is not a workman. Mrs. Wahi has relief upon the judgment of this Court in M/s. Sonata Marketing vs. Union of India & Ors. AIR 2001 SC 3507.
