Learned counsels for both the parties appear on call.
Today is fixed for submission of affidavit of admission/denial by the defendant-State and for further directions in the suit. The Office Report has been filed by the Branch indicating, inter-alia**, that the defendant-State has carried out inspection of the original documents on 22.01.2020.**
Learned counsel appearing for the defendant-State submits an affidavit of admission/denial affirmed on 15.02.2020 by Sh. Shamsudeen K.H., Chief Engineer, Inter State Waters, Irrigation Digitally signed by CHARANJEET KAUR Date: 2020.02.20 10:04:42 IST Reason:
Department, Government of Kerala, together with three copies thereof. Learned counsel for the plaintiff-State states that they have been served upon a copy of the affidavit. Let the said affidavit on behalf of the defendant-State be taken on record.
At this stage, learned counsel for the plaintiff-State submits that he has been recently entrusted with the matter by the State Authorities and that he has not been able to apprise himself with the voluminous records and accordingly, prays for some time on that ground. No objection is raised on behalf of defendant-State. The prayer is considered and allowed.
Let the matter come up on 25.02.2020 for further directions in the Suit.
