The matters above mentioned were listed before the Hon'ble Court on 16.08.2013, when the Court was pleased to pass the following order:

" Delay condoned.

Issue notice confined to the question as to whether the respondentInsurance Company could be exonerated from paying the compensation on the ground that the vehicle in question was not a light motor vehicle even if the driver of the vehicle was carrying licence to drive light motor vehicle.

Notice be made returnable within four weeks.

The request insofar as the grant of stay for payment of compensation by the petitioner to the claimants is concerned, the same is rejected."

Accordingly, show cause notice was issued on 02.12.2013 to both the common respondents through registered A.D. Post. Ms. Meera Mathur, Advocate has filed Vakalatnama & Memo of Appearance on behalf of Respondent No. 1 (common in both the matters). A.D. Card duly signed has been received back in respect of common Respondent No. 2 but no one has filed Vakalatnama & Memo of Appearance on behalf of the said respondent so far.

The matter above mentioned was lastly listed before the Ld. Registrar's Court on 19.08.2015, when the following Order was passed:

" The Learned counsel for the respondent No. 1 has stated that the petitioners have not provided the copies of the pleadings to him. The learned counsel for petitioners is directed to provide the copies of the pleadings to the learned counsel within a weeks' time and file proof. The respondent shall file the Counter Affidavit within a period of four weeks, thereafter.

Service of notice is complete on the respondent No.2 but no one has entered appearance on his behalf.

List again on 5.11.2015."

It is submitted that Counsel for common Respondent No. 1 has not filed Counter Affidavit so far.

It is further submitted that Dr.(Mrs.) Vipin Gupta, Counsel for the petitioner has on 24.08.2015 filed proof of providing pleadings on Ms. Neerja Sachdeva, Advocate who appeared before the Ld. Registrar's Court on 19.08.2015 for Respondent No. 1.

Service of show cause notice is complete.

The matters are listed before the Hon'ble Court with this office report.
