Mr Ravindra S Garia appears on behalf of the State of Uttarakhand.

$\mathbf{1}$ Notice was issued by this Court on 23 August 2021.

Mr Arvind Vashisth, Senior Counsel appearing on behalf of the petitioner, submits that the third and fourth respondents surrendered in pursuance of the order of the High Court, though beyond the extended period of 23 August 2021 which was granted by the High Court. Moreover, their bail applications are to be pending. As regards the fifth respondent, it has been submitted that he is absconding and has not surrendered by the date which was fixed by the High Court.

  • 4 Since the third and fourth respondents have surrendered, all that needs to be observed that the bail applications shall be dealt with in accordance with law without the learned Trial Judge being bound by any time schedule fixed by the impugned order of the High Court. The fifth respondent shall be dealt with in accordance with law.
  • 5 The Special Leave Petition stands disposed of.
  • 6 Pending application, if any, stands disposed of.
