UPON hearing the counsel the Court made the following O R D E R
Mr. V. Giri, learned Senior Counsel for the State of Tamil Nadu, has invited our attention to G.O.(2D) No.105, Water Resources Department, dated 14.12.2021 annexed as Annexure R1 (pages 10 to 20) to its counter affidavit and the necessary averments in support of the document at page 5 of the counter affidavit. However, document as well as the necessary averments do not say that the promotions so effected are regular promotions.
An affidavit to that effect shall be filed before the next date of hearing. The affidavit must also aver inter alia that the directions issued by this Court in its decision rendered in B. Thirumal v. Ananda Sivakumar & Others – (2014) 16 SCC 593, particularly, directions issued in paragraph 31 have been complied with.
Let the affidavit be filed on or before 01.11.2022. List the matter on 03.11.2022.
