For last about 10 months, this Bench has adjourned the case on six different dates to enable the ..2/- : 2 : Central Government to take appropriate decision on the recommendations made by different dates. In the last affidavit dated 24th January, 2012, which was filed in Court on 27th January, 2012, Shri K. Jose Cyriac, Secretary, Department of chemicals and Petrochemicals , disclosed that a draft of National Pharmaceutical Pricing Policy, 2011 was circulated among the concerned Ministries and stakeholders, requesting for their comments/views by 30.11.2011 and the letters were issued to all on 27.10.11 but responses have been received only from 8 Departments/Organizations out of 23 and 8 out of 11 Pharma Associations have responded. total number of responses received by the Department is 54. In para 5 of his affidavit Shri Jose has mentioned that responses from Ministry of Health & Family Welfare and Planning Commission is still awaited.

Shri P.P.Malhotra, learned Additional Solicitor General says that he will be in touch with the concerned officer and indicate the time limit within which the Government will take final decision, on the draft National Pharmaceutical Pricing Policy, 2011.
