I.A. No.5 of 2011: This is an application by the
Organisation of Pharmaceutical Producers of India for its
impleadment as a party respondent to the writ petition.
We<br>haveheardShriU.U.Lalit,learnedsenior

counsel appearing for the applicant and Shri Gonsalves, learned senior counsel appearing for the writ petitioners and are satisfied that ends of justice will be served by

granting leave to the applicant to act as intervenor in the writ petition.

The interlocutory application is accordingly disposed of.

Shri Ashok Bhan, learned senior counsel appearing for the Department of Chemicals and Pharmaceuticals made a request that he may be permitted to withdraw the affidavit of Shri Ram Chander, Under Secretary, Department of Pharmaceuticals and file affidavit of Shri K.Jose Cyriac, Secretary, Department of Chemicals and Petrochemicals having additional charge of Secretary, Department of Pharmaceuticals. The request of Shri Ashok Bhan is accepted. The affidavit of Shri K.Jose Cyriac is taken on record.

Yesterday, learned counsel assisting the learned Additional Solicitor General filed an additional affidavit of Shri P.K.Pradhan, Secretary to the Government of India , Department of Health and Family Welfare in the Ministry of Health & Family Welfare, New Delhi. 3

Today, learned counsel instructing Shri Gonsalves, learned senior counsel for the petitioners prayed and was granted leave of the Court to place on record further

affidavit. Copies thereof to the learned counsel assisting the learned Additional Solicitor General and other learned counsel.
