PETITION FOR SPECIAL LEAVE TO APPEAL(CRL.) NOS. 50165020 OF 2016

The matters above mentioned were listed before the Hon'ble Court on 05.07.2016, when the Hon'ble Court was pleased to pass the following order:

"Heard the learned counsel for the petitionerState and perused the relevant material. Delay condoned. Issue notice. Tag with Special Leave Petition(Crl.) No.3205 of 2016."

Accordingly show cause notice was issued to all the five respondents (sole respondent in each matters) through Regd. A.D. Post.

It is submitted that neither the A.D. Card nor the unserved cover containing the show cause notice was received back in respect of sole respondent in Special Leave Petition(Crl.) Nos. 5016 and 5019 of 2016.

It is further submitted that unserved cover containing the show cause notice was received back unserved in respect of sole respondent in Special Leave Petition(Crl.) Nos. 5017 and 5020 of 2016 with postal remarks "not claimed" and in respect of sole respondent in Special Leave Petition(Crl.) No. 5018 of 2016 with postal remarks "left without instruction".

Thereafter, the matters above mentioned were listed before the Court of Registrar on 17.01.2017, when the following order was passed:

"The Ld. Counsel for the petitioner to take fresh steps for service of the sole respondent in all the matters alongwith fresh address of the sole respondent

in SLP(Crl.) No.5017, 5018 and 5020/2016 within two weeks' time. Notice thereafter be issued. List again on 20.2.2017."

It is submitted that since Counsel for the Petitioner did not taken fresh steps in respect of sole respondent in all the matters and also not furnished fresh address in respect of sole respondent in Special Leave Petition(Crl.) No. 5017, 5018 and 5020 of 2016, the matters above mentioned were listed before the Court of Registrar on 20.02.2017 and when again listed on 24.03.2017, the following order was passed:

"Despite last opportunity having been granted, fresh steps alongwith fresh address of the sole respondent have not been taken/furnished. Registry to process the matter for listing before the Hon'ble Judge in Chambers for further directions."

It is lastly submitted that Counsel for the Petitioner has still not taken fresh steps for service on sole respondent in all the matters and also not filed fresh address in respect of sole respondent in Special Leave Petition(Crl.) No. 5017, 5018 and 5020 of 2016.

Service of show cause notice is incomplete.

The office report for direcetions in the matters above mentioned were listed before the Hon'ble Judge in Chambers.
