The matters above mentioned were listed before the Ld. Registrar's Court on 4 th October, 2016 when he was pleased to pass the following Order:

"Four weeks' time, as last opportunity, is granted to respondent Nos.1 and 3 to 14 for filing counter affidavit.

Vakalatnama on behalf of the legal representatives of the deceased respondent No.2 has been filed by the Ld. Counsel appearing for the remaining respondents but proof of death has not been filed. Death Certificate be filed within two weeks' time and if petitioner is desired to take steps for substitution of the legal representatives he may take within two weeks' time thereafter. Registry to process under rules. List again on 5.12.2016."

It is submitted that Mrs. Sarla Chandra, Advocate on behalf of Respondent Nos. 1 and 3 to 14 and has on 22nd November, 2016 filed Counter Affidavit on their behalf after serving its copy on the other side.

It is further submitted that the Counsel for LR's of deceased Respondent No. 2 has not filed valid proof regarding demise of Respondent No. 2 till date and the Counsel for the Petitioner has not taken steps for substitution of the Legal Respondent till date.

Service of notice is not complete on Respondent No. 2

The matters abovementioned are listed before the Ld. Registrar's Court with this office report.
