UPON hearing the counsel the Court made the following O R D E R

Separate reports have been filed by the applicants in I.A. No.189174/2022 and the petitioner, both seeking to claim a particular view the Revenue Authorities have taken in respect of their land. The fact is, on enquiry, that the demarcation has been done in the absence of either of the parties.

In order to put an end to this dispute, we consider it appropriate to direct that the demarcation will take place in the presence of both the parties and to avoid such a situation in future we also consider it appropriate to fix the date and time when the concerned revenue authorities will begin the demarcation process and submit the consequent report to us. Let the demarcation began on 13.2.2023 onwards supervised by the District Magistrate at 11:00 a.m. If the parties do not participate, it will be presumed that they have nothing to say.

The District Magistrate will make adequate arrangements for providing police force to ensure smooth demarcation.

Learned ASG submits on behalf of SFIO that insofar as the claims filed before the first cut off date, they have been verified but the claims filed after that before the second cut off date are in the process of being verified.

The second part of the process is expected to be over before the next date.

Learned counsel for the petitioner states that to the extent of verification done, they have no cavil to the verified claims nor to the Committee sought to be constituted to disburse of the claims thus the only issue is to see the land to be sold to the third parties who will pay the amounts and thus satisfy the claims.

Learned counsel appearing for respondent No.13 seeks to raise an issue that she has not received the amount as per what the petitioner claims through RTGS process. This aspect may be verified.
