UPON hearing the counsel the Court made the following O R D E R
IA No 133919 of 2024 In SLP (Crl) No 13501 of 2023
- 1 By an order dated 17 May 2024, the respondents were given time to verify the medical certificates relied upon by the petitioner and the interim bail was extended for a further period of four weeks, subject to furnishing bail bonds to the satisfaction of the trial court.
- 2 Pursuant to the above order, an affidavit has been filed on behalf of the State of NCT of Delhi wherein it is stated that the medical treatment certificates were verifiable. However, a stand has been taken that the persons who were advised medical treatment have not taken recourse to medical treatment and, therefore, that ground may not be available to the petitioner for seeking interim bail.
- 3 Counsel for the petitioner prays for and is allowed two weeks' time to file an affidavit in response to the counter affidavit filed on behalf of the NCT of Delhi.
- 4 List this matter in the second week of July 2024 before the appropriate Bench.
- 5 In the meantime, the interim bail period is extended up to 19 July 2024.
- 6 The interlocutory application for extension of bail is disposed of.
