The learned counsel appearing for the parties agreed that paragraph 16 of the impugned order may be modified by appointing a retired Judge of the High Court of Calcutta, who is a resident of Kolkata, West Bengal, as the sole Arbitrator. Accordingly, we had called for a list of empanelled Arbitrators from the High Court of Calcutta. We have perused the said list.

We modify paragraph 16 of the impugned order by appointing Shri Justice Ashim Kumar Banerjee, a former Judge of the High Court of Calcutta, as the sole Arbitrator. Necessary intimation be sent by the Registry of this Court to Shri Justice Ashim Kumar Banerjee, the sole Arbitrator, at the following address:

" Shri Justice Ashim Kumar Banerjee, Former Judge, High Court of Calcutta, "THNAI" BB 21, New Town, Kolkata – 700 156, West Bengal"

The Appeal is, accordingly, disposed of.
