The matter above mentioned was listed before the Hon'ble Court on 4.8.2014 when the Court was pleased to pass the following order :

" The application for permission to file the special leave petition is allowed. Delay condoned.

The application for substitution is allowed.

Learned counsel for the petitioners vehemently contends that the order dated 09.07.1960 would be deemed to have acquired finality if the land had been used. However, since the land was not utilised at the time of death of the original owner Om Parkash, the rights of each of the legal heirs of Om Parkash had to be redetermined.

Issue notice. List with SLP(C)No.28992 of 2012 and connected matters."

Accordingly show cause notice has been issued to all the respondents by Registered A.D. Post on 19.9.2014.

Service of show cause notice is not complete on respondent Nos. 4(iv), 4(vii), 6 & 7.

Being service incomplete, the matter was listed from time to time before the Ld. Registrar Court and lastly listed on 21.1.2016 and 8.3.2016, when the following order was passed:

Order dated 21.1.2016

" Four weeks time, as last chance is given to the learned counsel for the petitioners to comply with the terms of the order dated 13.10.2015 of this Court in respect of Respondent Nos. 4(iv), 4(vii), Respondent No. 6 and 7.

Four weeks time is given to the other appearing respondents to file the counter affidavit.

List again on 8.3.2016."

Order dated 8.3.2016

" Ld.counsel for the petitioner has failed to comply the order dated 21.01.2016 of this Court in respect of respondent Nos. 4(iv), 4(vii), 6 & 7 despite opportunities given. Therefore, the matter shall be processed for listing before the Hon'ble Judge in Chambers for further future directions. Await orders and list thereafter."

It is again submitted that counsel for the petitioner has neither furnished fresh particulars nor taken fresh steps hence fresh show cause notice could not be issued to respondent nos. 4(iv) and 4(vii). He has also not filed application for substitution in respect of deceased respondent nos. 6 & 7.

The office report on default is listed before the Hon'ble Court(In Chamber)for orders.
