UPON hearing the counsel the Court made the following O R D E R

Without prejudice to the rights and contentions of the parties and looking to the peculiar facts of this case, we are of the view that it would be appropriate if the High Court decides the disputes between the parties on merits.

Accordingly, we set aside the orders passed by the High Court and request the High Court to decide the issues raised on merits.

The special leave petitions are disposed of.

Pending application, if any, stands disposed of.
