The matters above mentioned were listed before the Hon'ble Court on 13.03.2015 before the Hon'ble Court When the Court was pleased to pass the following order:
"Delay condoned.
Appeals admitted.
We are informed that apart from holding that the respondents concerned are entitled to the benefit of reimbursement of the Minimum Alternate Tax(MAT), the actual amounts are yet to be quantified. The Commission is directed to assess the amounts said to be due
to the respondents, within a month from date. On such assessment being made, the appellants shall secure 50 per cent of the amount due by way of Bank Guarantee on any nationalised bank and the remaining amount shall be paid directly to the respondent no. 2, within one month thereafter. Tag with Civil Appeal No. 6036 of 2012."
It is submitted that NLPA was issued on 08.04.2015 to the respondents through Tribunal. Mr. Pukhramabam Ramesh Kumar, Advocate has entered appearance on behalf of respondent no. 2 in both the matters and has also filed counter affidavit. Certificate of Service in respect of common respondent no. 1 in both the matters has been received from the Tribunal but no one has entered appearance on its behalf. Service is complete in both the matters.
It is further submitted that Counsel for the appellant has not filed any documents in view of the sbove said orders.
The matters above mentioned were again listed along with Connected matters before the Hon'ble Court on 16.09.2015 When the Court was pleased to pass the following order:
C.A.No.4585/2012:-
Learned Counsel for both parties state that the facts as well as questions of law which arise in this appeal are dissimilar to those in C.A.No.6036/2012 etc. and hence shall not be deemed to have been tagged with those Appeals i.e. CA.NO.6036/12 etc. Ordered accordingly. The Appeal will come on its own turn.
C.A.Nos.3006 & 3007/2015:- These appeals are de-tagged and will come on their own turn.
In rest of the Appeals hearing is concluded. The Court reserved its verdict.
It is submitted that Civil Appeal No. 6036 of 2012 along with connected matters were listed before the Hon'ble Court on 16.10.2015 when the Court was pleased to pass the following order: (Copy of the Judgment is enclosed herewith)
"The Appeals are dismissed but without any order as to costs in terms of the Signed Reportable Judgment. "
