It is submitted for the information of the Hon'ble Court that the instant matter has been filed against the Judgment and Order dated 02.05.2016 of the High Court of Delhi at New Delhi in WP(C) No. 6401/2015. The matter initially filed on 21.09.2016 is barred by time by 52 days. The matter was found defective and returned to the counsel. He has on 29.11.2016 refiled the matter after curing the defects which is barred by time by 43 days. Counsel for the petitioner has also filed an application for exemption from filing certified copy of impugned order (unregistered) and the same has been included in SLP Paper Books.
It is further submitted that Civil Appeal No. 8656/2016 @ Special Leave Petition(C) No. 10159/2016 arising out of similar issue was listed before the Hon'ble Court on 31.08.2016, when the Court was pleased to dismiss of the same. Copy of Judgment dated 31.08.2016 is enclosed herewith.
It is further submitted that Civil Appeal No. 11580/2016 @ Special Leave Petition(C) No. 35537/2016 @ SLP (C) CC No. 22227/2016 arising out of similar issue was listed before the Hon'ble Court on 02.12.2016, when the Court was pleased to dismiss of the same. Copy of Judgment dated 02.12..2016 is enclosed herewith.
