The matter above-mentioned was listed before the Ld. Registrar Court on 15.09.2016, when the Court was pleased to inter alia pass the following order:

"None appears for respondent Nos. 1, 6, 16, 23, 24, 25, 31 and 34 despite due service. Respondent No. 2 to file counter affidavit within four weeks' time.

Learned counsel for the petitioners shall take fresh steps for effecting service on respondent Nos. 3 to 5, 7 to 15, 17 to 22, 26 to 30, 32 to 33 and 35 within two weeks' time and notice thereafter be issued.

List again on 23.11.2016."

It is submitted that Counsel for the petitioner has not filed spare copy of SLP, but she has filed an application for deletion of the Respondent Nos. 3-5,7-15,17-22,26-30,32-33 and 35 with Affidavit the same is yet to be listed before the Hon'ble Judge-in-Chamber Court. Counsel for Respondent No.2 has not filed Counter Affidavit so far. A.D. Cards duly signed have been received back in respect of Respondent Nos. 6, 16, 23-25, 31, 34, but no one has entered appearance so far. Mr. Surya Kant, Advocate for Respondent No. 2 has not filed counter affidavit so far. Mr. Rohit K. Singh, Advocate has on 24.09.2016 filed Vakalatnama and Memo of appearance on behalf of Respondent No. 1, but he has not filed counter affidavit so far.

The matter above-mentioned was listed before the Hon'ble Court on 16.09.2016, when the Court was pleased to pass the following order:

"Delay condoned. Issue notice. Application for deletion of the names of proforma respondent 3 to 5 is allowed and their names are deleted from the arrays of parties. Cause title be amended accordingly. Tag with SLP [C] No. 15386/2016."

It is submitted that accordingly notice was issued to both the respondents through registered AD. Post on 28.09.2016. M/s. Surya Kant and Rohita K. Singh, Advocates has on 2.10.2016 and 07.11.2016 filed Vakalatnama and Memo of appearance on behalf of Respondent Nos. 1 and 2 respectively, but Counter Affidavit has not filed so far. The name of respondent Nos. 3 to 5 has been deleted from the array of parties vide Court's order dated 16.09.2016 (In Chamber).
