The matter above-mentioned was listed before the Hon'ble Court on
23rd April, 2014, when the Court was pleased to pass the following Order:
"At the time of hearing of this petition, Respondent No. 2 had stated that the value which had been casually stated by the petitioner about the property is not fair and, therefore, he would like to value the property himself. Upon knowing the valuation, the petitioner shall have a right either to purchase the share of Respondent No. 2 or he shall sell his share at the said value to Respondent No. 2.
List on 17.07.2014.
Valuation shall be done within four weeks. Respondent No.2 shall communicate the same to the petitioner within six weeks from today."
Subsequently, the matter above-mentioned was listed time to time and lastly listed before the Hon'ble Court on 7 th December, 2016, when the Hon'ble Court was pleased to pass the following order:
"List the matter after six weeks to enable the learned Mediator to file the report."
It is submitted to the Hon'ble Court that with reference to this Court's Order dated 7 th December, 2016, a Mediation report has been received from Supreme Court Mediation Centre stating therein that parties could not arrive at an amicable settlement. Hence, Mediation is unsuccessful.
It is further submitted that Mr. D. Mahesh Babu, Counsel for the Respondent No. 2 has on 22nd January, 2014 filed the affidavit on behalf of Respondent Nos. 2 and 5 but no Vakalatnama/appearance on behalf of Respondent No. 5 has been filed copy of the affidavit has been included in SLP paper books.
It is further submitted that Mr. Ananga Bhattacharyya, Counsel for the Petitioner has filed an Application for extension of ad-interim Stay but the said application is defective as full court fee in support of application has not been filed by the counsel so far. Therefore, Application being unregistered abovesaid could not be placed before the Hon'ble Court in compliance of Circular dated 29th April, 2013.
It is further submitted that there are total 5 respondents in the matter Mr. K. Shivraj Choudhuri, counsel for respondent No. 1 and Mr.D. Mahesh Babu, counsel for Respondent No. 2 has filed Counter/Affidavit and the same has been included in SLP Paper books. M/s. Lawyer's Knit & Co., Advocate has filed Vakalatnama and appearance on behalf of Respondent No. 3 but no counter affidavit has been filed so far. Service is complete on Respondent Nos. 4 and 5 through affidavit of dasti but no one has entered appearance on their behalf so far.
Service is complete.
The aforesaid matter is listed before the Hon'ble Court with this office report.
