UPON hearing the counsel the Court made the following O R D E R
- 1 The delay in filing the Special Leave Petition which has been reported by the Registry is due to the challenge to the order of the learned Single Judge dated 18 May 2022. Mr Neeraj Kumar Jain, senior counsel appearing on behalf of the petitioner states that the challenge would be confined to the order of the Division Bench dated 22 March 2024 rendered in a writ appeal.
- 2 Delay condoned.
- 3 Issue notice.
- 4 Dr Abhishek Manu Singhvi, senior counsel appears on behalf of respondent on caveat and waives service.
- 5 Counter affidavit shall be filed within a period of four weeks. Rejoinder, if any, be filed within a period of two weeks thereafter.
- 6 Pending further orders, there shall be a stay of the operation of the impugned judgment and order of the Division Bench of the High Court of Calcutta dated 22 March 2024. The contempt proceedings before the High Court shall stand deferred pending the disposal of the Special Leave Petition.
- 7 List the Special Leave Petition on 15 July 2024.
