REVISED OFFICE REPORT FOR DIRECTIONS

The matter above mentioned was listed before the Hon'ble Court on 09.07.2015 when the Court was pleased to pass the following Order:-

"Delay condoned. Issue notice, returnable in four weeks. There shall be stay of the impugned judgment in the meantime."

It is submitted that there are two respondents in each SLPs. (Respondent No. 2 is common in both SLPs). Show cause notice to all the respondents was issued on 12.10.2015 by regd. A.D. Respondent No. 1 in SLP(C) No. 19774/2015 is represented by Dr. Monika Gusain, Advocate and respondent No. 1 in SLP(C) No. 19775/2015 has entered appearance as in-person. Nothing has been received from respondent No. 2 (common in both SLPs). Dasti show cause notice in respect of respondent No. 2 was handed over to counsel for the petitioner vide Ld. Registrar order dated 18.03.2016, but he has not filed Affidavit of proof of dasti service so far.

For non-completion of service on respondent No. 2, the matter was listed before the Court of Ld. Registrar from time to time and lastly listed on 19.04.2016, when he was pleased to pass the following order:-

"Despite last opportunity having been granted, affidavit of proof of dasti service in respect of respondent nos. 1 and 2 has not been filed by the ld. Counsel for petitioner.

As such, process the matter for listing before Hon'ble Judge-in-chambers for further directions."

It is further submitted that respondent No. 1 is represented by Dr. Monika Gusain, Advocate in SLP(C) No. 19774/2015 and respondent No. 1 in-person in SLP(C) No. 19775/2014. Counsel for the petitioner has on 05.05.2016 filed affidavit in respect of common respondent No. 2 stating therein that copy of the notice served to respondent No. 2 (UPSC) on 13.04.2016 enclosing therewith a copy of letter dated 13.04.2016 sent by the petitioner to Secretary, UPSC with notice without proof of dasti service of notice on respondent No. 2. (Copy of Order dated 13.04.2016 is enclosed herewith)

It is lastly submitted that Ms. Binu Tamta, Advocate has on 07.06.2016 filed vakalatnama/appearance on behalf of respondent No. 2 (common respondent in both SLPs) with application for deletion of name of respondent No. 2 from the array of parties (regd. as I.A. Nos. 7 & 8) and the same has been placed with SLP paper books.

The matter alongwith application above-mentioned is listed before the Hon'ble Judge in Chambers with this Office Report for directions.
