UPON hearing the counsel the Court made the following O R D E R

SLP(C) No. 8670-8672/2023

Respondent Nos.9 & 24 in SLP(C) No.8670/2023, respondent Nos.8 & 25 in SLP(C) No.8671/2023, respondent Nos.7 & 24 in SLP(C) No.8672/2023 are granted three weeks' time, as last opportunity, for filing counter affidavit.

Ld. Counsel for the petitioner has filed an Application for substitution in respect of respondent No.13 in SLP(C) No.8670/2023, respondent No.11 in SLP(C) No.8671 and 8672/2023 but notified to be defective. Defects be cured as per rules. At this stage, Ld. Counsel for the petitioner submits that legal representatives of deceased respondents are already on record and he will move a letter in that regard. Submission is taken on record. Thereafter, Office to verify and rectify the records accordingly.

Ld. Counsel for the petitioner submits that as per paper book K.Suresh is respondent no.14 though notice has been issued to respondent No.13. Office to verify and update the records.

Ld. Counsel for the petitioner submits that he does not have any fresh particulars in respect of the unserved respondents and makes request to serve notice on the previous address. Submission is taken on record. Ld. Counsel for the petitioner is granted two weeks' time, as last opportunity, to take fresh steps in respect of the unserved respondents. Thereafter, notice be issued on the previous address. Ld.

Counsel also makes request for service to be effected through the concerned Trial Court/through the counsel appearing before the Trial Court. Allowed. Necessary details be furnished within one week. Notice thereafter be issued accordingly.

Ld. Counsel for the petitioner has filed an Application for substitution in respect of respondent No.15 in SLP(C) No.8670 and 8672/2023 and respondent No.16 in SLP(C) No.8671/2023 alongwith an Application for condonation of delay in filing the setting aside abatement. Process as per rules.

Ld. Advocate, Ms. Gauri Pande, appearing on behalf of Mr.Dhawesh Pahuja, Advocate-on-record appears for respondent Nos.3, 11 and 14 in SLP(C) No.8670-8672/2023 and prays for time to file vakalatnama and counter affidavit on behalf of respondent Nos.3 and 14. Be filed within three weeks. Ld. counsel further submits that vakalatnama on behalf of respondent No.11 – K.N. Mohan in SLP(C) No.8670-8672/2023 has been filed and prays for time to file counter affidavit. Office to verify and update the records. Counter affidavit be filed within three weeks.

Service is complete on the remaining respondents, but none has entered appearance.

As per office report, Ld. Counsel for the petitioner has filed an Application for substitution in respect of respondent No.11 (dead) but it has been notified to be defective.

Ld. counsel appearing for respondent No.2 seeks time to file vakalatnama and counter affidavit. Be filed within three weeks.
