UPON hearing the counsel the Court made the following O R D E R

Arising out of an order of remand passed in the second appeal by the High Court, the present special leave petition has been filed.

Mr. Sanjay M. Nuli, learned senior counsel, has strenuously urged that without formulating the substantial question of law remand as directed is not justified.

Having considered the subject matter of the case, due to not formulating the substantial question of law, while directing remand, in our view no prejudice is going to be caused to the parties, therefore, we are not inclined to entertain the present special leave petition.

Accordingly, the special leave petition is dismissed. Pending application(s), if any, shall stand disposed of.
