Heard Mr. Uma Kant Misra, learned counsel 1. Delay condoned. appearing for the petitioners.
$2.$ The counsel submits that following the decision in the case of Narusu Pradhan v. State of Odisha rendered on 11.06.2009 in O.A. No. 1189(c) of 2006 by the Odisha Administrative Tribunal, relief was granted to the respondent No. 1, who superannuated on 03.04.2015. The respondent No. 1 at that point of time, was Signal we Not Verify in the work charge establishment since 01.03.2009. The <sup>15,34</sup><br><sup>15,34</sup><br><sup>15,35</sup><br>arned Single Judge issued order to count his service, rendered in the work charge establishment, for computing the retirement

benefits of the respondent No. 1. The Division Bench however dismissed the State's Writ Appeal on the ground of delay by relying on the judgment of the High Court in State of Odisha v. Surama Manjari Das (W.P.(C) No. 15763 of 2021 dismissed on 16.07.2021).

4. In the meantime, the interim order dated 22.03.2021 in SLP (Civil) Diary No. 6184 of 2021 will operate in the present matter as well.
