UPON hearing the counsel the Court made the following O R D E R
Issue notice, returnable in the month of December 2023.
Notice will be served by all modes including dasti.
In the meanwhile, subject to the appellant - Agra Development Authority depositing an amount of Rs.25,00,000/- (Rupees twenty five lakhs only) with the Uttar Pradesh Pollution Control Board, there will be stay of direction to deposit the balance amount. This payment will be in addition to interim payment already made. Further, the appellant - Agra Development Authority must comply with the other directions issued in the impugned judgment, as well as, by the Uttar Pradesh Pollution Control Board/Authority. In case there is non-compliance of any of the directions, the appellant -Agra Development Authority may be asked to deposit a further amount. Compliance report will be filed by the appellant- Agra Development Authority and the Uttar Pradesh Pollution Control Board bissue of Section before 30.11.2023.
