Learned counsel contends that by the order dated 12th August, 2008, a direction had been issued that the case of the respondents herein be considered for promotion from the date when their juniors had been promoted, but during the 2

pendency of a contempt petition, the order dated 29th May, 2009 had been passed despite the fact that the direction was that the promotion be made subject to the result of the litigation that was pending and also subject to any matter which may be filed in the Supreme Court.

In view of the above, issue notice.
