It is submitted that the above mentioned Special Leave Petition is filed by Mr. Gagan Gupta, Advocate on 23.09.2016 against the Judgment and Order dated 15.02.2016 of the High Court of Punjab and Haryana at Chandigarh in RFA Nos. 4978, 4980, 4979, 5664 of 2013, 5802 of 2012 and 5282 of 2010 alongwith application for permission to file Special Leave Petition and exemption from filing official translation.
It is further submitted that Counsel for petitioner has also filed an application for substitution to bring on record the LRs. of deceased Petitioner No. 5 viz Sahaj Kaur in RFA No. 4980 of 2013, Petitioner No. 1 viz Kaptan Singh in RFA No. 4979 of 2013 and Petitioner No. 2 viz Surat Singh in RFA No. 4979 of 2013 which are barred by time by 297, 876 & 765 days respectively and Counsel has also filed an application for condonation of delay in filing substitution application and prayer for setting aside abatement.
It is further submitted that Counsel for the petitioner has filed two applications for condonation of delay in filing the SLP and refiling the SLP (i) there are delay of 86 days in filing the SLP in RFA Nos. 4978, 4980, 4979 & 5664 of 2013, 92 days in RFA No. 5802 of 2012, 95 days in RFA No. 5282 of 2010 (ii) a delay of 79 days in refiling the SLP. There is a total delay of 165, 171 & 174 days in filing and refiling the SLP.
It is further submitted that SLP (C) No. 27862 of 2016 @ CC No. 16341 of 2016 Entitled Roshan Lal & Anr. Versus Land Acquisition Collector & Ors. arising out of relied upon Judgment was dismissed on 09.09.2016 by Hon'ble Court. (Copy of order dated 09.09.2016 is enclosed herewith).
It is further submitted that SLP (C) No. 17190 of 2016 Entitled Karan Singh Versus State of Haryana & Ors. arising out of common Order was disposed of as withdrawn on 18.07.2016 by Hon'ble Court. (Copy of order dated 18.07.2016 is enclosed herewith).
It is further submitted that SLP (C) No. 10115 of 2016 Entitled Ramseh Thakran And Ors Versus State Of Haryana And Anr arising out of common Judgment was dismissed on 02.05.2016 by Hon'ble Court. (Copy of order dated 02.05.2016 is enclosed herewith)(Main matter is SLP (C) No. 8519 of 2016).
It is further submitted that SLP (C) No. 23844 of 2016 Entitled Ram Rikh And Ors. Versus State Of Haryana And Ors. arising out of similar issue was listed before the Hon'ble Court on 27.10.2016 when the Hon'ble Court was directed to issue of notice. The said SLP is pending after notice.(Copy of order dated 27.10.2016 is enclosed herewith)(Main matter is SLP (C) No. 1427714327 of 2016).
The matter is listed before the Hon'ble Court with this office report.
