UPON hearing the counsel the Court made the following O R D E R

IA No. 6929/2022 in SLP(C) No. 3136/2016:

The grievance which is voiced in the present application is that, despite the order of status quo of possession and title, the original petitioners - Sayyed Hamid Latif and Syed Amin Latif are putting up the construction illegally for which even the Ahmednagar Municipal Corporation has also issued a notice on 22.12.2021.

Mr. Tejasvi Kumar, learned Advocate, has appeared on behalf of the original petitioners – Sayyed Hamid Latif and Syed Amin Latif

Issue notice, returnable on 25.02.2022.

The petitioners before this Court Sayyed Hamid Latif and Syed Amin Latif are hereby restrained from putting up any further construction on the property in question.

The Commissioner, Ahmednagar Municipal Corporation is hereby directed to prepare a panchnama and submit a report to this Court with respect to the construction and/or position of the property in question being Bhangar/Chavni Parishad, G.L.R. No. 716, G.P.O. Road, Ahmednagar for which even a notice has been issued by the Corporation on dated 22.12.2021. The Report to be submitted to this Court before the next date of hearing.

Dasti**, in addition, insofar as the present order to be served upon the Commissioner, Ahmednagar Municipal Corporation is concerned.**
