UPON hearing the counsel the Court made the following O R D E R
By order dated 28.4.2016, we had clarified that several Associations with whom there had been settlements may also be called for settlement talks by Air India.
It appears that one Association namely Indian Pilots Guild who is the petitioner in SLP(C) Nos.17417-17418 of 2014 has been left. We clarify that the Indian Pilot Guild Association, without prejudice to the rights and contentions available to both the parties, may also be called for talks by the Air India so as to see any possibility of peaceful settlement between the parties.
We have been informed by the various Associations that despite this Court's order dated 28.4.2016, no positive steps have been taken by the Air India to have meaningful talks with various Associations. In the light of the fact that the Air India is very keen to purchase peace with its employees, we therefore clarify that in case those Associations referred to in our earlier order dated 28.4.2016 and the order of this date, have not yet been called for any discussion or talks, Air India will do so within one month from today and a report on the said discussion thus to be held by the Air India with the various Associations as referred to in the aforesaid order and the order of this date, be submitted to this Court positively on the next date of hearing.
We make it clear that this is without prejudice to the contentions available to the Air India that they hold discussions/talks only with the recognised Associations. We do not think that there could be any formidable difficulty in having discussions with various Associations with whom the Air India had settlements at one time. The present order is made only keeping in view of the fact that the Air India is keen to have peace in its establishment.
