We have heard learned counsel for the parties.

ITEM NO.12.1 COURT NO.2 SECTION XII-A

The objection to the substitution is that the rights of the original appellant stand extinguished and therefore, the legal representatives should not have been brought on record.

On consideration of the matter, we are of the view that this is an aspect we can consider while dealing with the appeal as leave has already been granted. No purpose would be served at this stage on spending time on this issue.

The application is thus allowed and amended memo of parties be filed within a week. This is subject to the objection raised by the respondents.
