UPON hearing counsel the Court made the following O R D E R During the course of further hearing, Shri K.K. Venugopal, learned senior counsel appearing for
the Central Bureau of Investigation (for short, "C.B.I.") raised an objection that the learned counsel for the petitioners is being permitted to make submissions on the basis of the report of the Comptroller and Auditor General (for short, 'C.A.G.") without the same being taken on record. Since the C.A.G. Report was filed before the Court last week and the same has been referred more than once, the Court felt that there will be no objection to the same. However, as the objection has been raised, we deem it proper to take it on record. Shri Venugopal then submitted that the C.B.I. may be permitted to furnish a status report to the Court in a sealed cover. We accept the request of the learned senior counsel. The report of the C.B.I. on the present status of investigation may be made available to the Court in the sealed cover. For further arguments, the case be listed on 30.11.2010.
