The matters above-mentioned were listed before the Hon'ble Court on 13th May, 2016 when the Hon'ble Court was pleased to pass the following order:-

"The petitioner is the auction purchaser and the said auction was held to be illegal by the Courts below with a direction to refund the amount of Rs. 80 lakhs which was paid by the petitioner. The High Court has, however, denied the interest on the paid amount. Issue notice limited to the issue as to whether interest should be granted or not, returnable in six weeks."

Accordingly, show cause notice returnable on 18th July, 2016 was issued to all the fourteen respondents through registered A.D. Post on 2nd June, 2016. Neither A.D. Card nor Unserved Cover containing the show cause notice has been received back from Respondent No. 6 (Common Respondent No. 4 in SLP 13818, 13819 & 13822 of 2016, Common Respondent No.5 in SLP (C) Nos. 13820 & 13821 of 2016 and Respondent No. 3 in SLP 13823 of 2016) so far.

It is submitted that the all the remaining Respondents have been served with notice on 7th and 8th July, 2016 as per delivery report received from the Postal Authority but no one has filed Vakalatnama/Appearance on their behalf. A copy of the show cause notice was also issued to Mr. B. Balaji, Advocate (Standing Counsel for the State of Tamil Nadu) but he has not filed Vakalatnama/Appearance on behalf of the Respodent/State of Tamil Nadu so far.

The matters are listed before the Hon'ble Court with this Office Report Dated this the 14th Day of July, 2016.
