UPON hearing the counsel the Court made the following O R D E R

  • 1 We have heard Mr Pradeep Agarwal, learned counsel for the petitioner and Ms Tannishtha Singh, learned counsel for the respondent.
  • 2 Mr Justice M S Rane, former Judge of the High Court of Judicature at Bombay has expressed his inability to continue with the arbitration proceedings on grounds of health.
  • 3 In the circumstances, instead and in place of Mr Justice M S Rane, Mr Justice S M Jhunjhunuwala, former Judge of the High Court of Judicature at Bombay, is appointed as sole Arbitrator. The Arbitrator is requested to fix his fees in terms of Schedule IV of the Arbitration and Conciliation Act 1996.
  • 4 The Miscellaneous Application is disposed of.
