The writ petition above-mentioned was listed before the Hon'ble Court on 20.09.2016, when the Court was pleased to pass the following order:
"Issue notice. Dasti, in addition, is also permitted. Tag with S.L.P. (C) No. 6661 of 2016 etc."
It is submitted that pursuant to the aforesaid order, show cause notice has been issued to all four respondents by speed post on 29.09.2016. The notices have been delivered on respondent nos. 2 to 4 as per the tracking information of the postal authorities. Respondent no. 1 has refused to accept notice as per the tracking information of the postal authorities.
It is further submitted that dasti notice was handed over to the counsel for the petitioner and he has on 06.10.2016 filed affidavit of dasti service along with proof of service after serving dasti notice on respondent nos. 2 to 4 personally and served respondent no. 1 by speed post.
It is further submitted that the counsel for the petitioner has on 23.09.2016 filed applications for stay and directions and the same have been registered as I.A. nos. 1 and 2 respectively (copy of the same as a separate paper book is placed below).
Thereafter, the writ petition above-mentioned was listed before the Hon'ble Court on 09.11.2016 with other connected matters, when the Court was pleased to pass the following order:
"Mr. Mohan Prasaan, learned senior counsel appearing on behalf of the State Government seeks a week's time, so as to enable him to obtain instructions with regard to payment of salary to the serving employees. Post for hearing on 16.11.2016. Instructions be obtained, in the meantime. Liberty to file a short affidavit as well."
It is submitted that pursuant to the aforesaid order, nothing has been filed on behalf of the State of West Bengal so far.
Service of notice is complete.
The writ petition along with applications above-mentioned is listed before the Hon'ble Court with this office report.
