UPON hearing the counsel the Court made the following ORDER
Respondent nos.18 and 216 have already filed counter affidavit.
Four weeks time, is granted to respondent no.48 to file counter affidavit.
Mr. Anubhav Sharma, Ld. Advocate appearing for Mr. Mohit D. Ram, Ld. AOR seeks for time to file vakalatnama and counter affidavit on behalf of respondent nos.13 to 15. Four weeks time, is ature Not Verified Taked for the said purpose.
Appearing respondents have failed to file counter affidavit, within the time stipulated under the rules.
Ld. counsel for petitioner has failed to take appropriate steps, for effecting service upon unserved respondents and also failed to file application for substitution in respect of deceased respondents.
However, Ld. Counsel for petitioner seek further time for taking appropriate steps and filing application. Already last chance was given to the petitioner vide record of proceeding dated 11.10.2023, but no steps have been taken so far and no reason for the inaction has been cited. Hence, there are not ground for which further time can be given.
Since the petitioner has failed to take adequate steps, process the matter for listing before the Hon'ble Judge-in-Chambers, for further directions.
