C.A. No. 4388/2016:-

The appeal was listed before the Hon'ble Judge in Chamber on 15/12/2016 with office report on default dated 26th November,2016, when the Court was pleased to pass the following order:-

"Learned counsel for the petitioners prays for and is granted further four weeks, time to move an application for substitution to bring on record the Lrs. Of deceased Respondent No.2 and also to furnish correct particulars of unserved Respondent No.5."

It is submitted that application for substitution for bringing Lrs. Of deceased respondent No.2 is awaited and fresh address of respondent No.5 has not been filed so far.

further submitted that there are 6 respondents in this appeal. Respondent Nos. 1 & 4 are represented by Mr. Satpal Singh, Advocate and he has also filed counter affidavit. Certificate of service has been received from the High Court in respect of respondent Nos. 2, 3, 5 & 6 and stating therein that R.Nos. 3 & 6 has been served but R. Nos. 2 & 5 have not been served and informed the Registry "Respondent No.2 died on 5/12/2014, as per his wife" & Respondent No.5 "Retired from the Railway Service Deptt. On 31/10/96. ..2/-

Service is not complete in respect of respondent Nos. 2 & 5.

CIVIL APPEAL NOS. 5497 & 5498/2016:-

It is submitted that there are 31 respondents in C.A. No. 5497/2016 & 14 respondents in C.A. No. 5498/2016. Notice of lodgment of Petition of Appeal has been issued to all the respondents through High Court in Civil Appeal No. 5497 on 06.08.2016 and Reiminder has been issued on 30/08/2016 and on 24/12/2016. Certificate of service only in Respondent No.20 in Civil Appeal No. 5497 of 2016 and in respect of other respondents in appeals is still awaited from the High Court. In C.A. No. 5498/2016 Notice of lodgment petititon of appeal has been issued on 24/08/2016 and Certificate of Service is awaited and reminder has been issued to the High Court.

Service of notice of lodgment of Petition of Appeal is not complete.

The appeals above-mentioned are listed before the Court of Ld. Registrar with this Office Report as incomplete matters. DATED THIS THE 24th DAY OF December, 2016.
