O R D E R
When the matter is taken up today, Mr. Kapil Sibal, learned senior counsel appearing for the first respondent handed over two Demand Drafts for an amount of Rupees Ten crores to Mr. Tushar Mehta, learned Additional Solicitor General appearing for the petitioner and submitted that according to the instructions, the petitioner herein held an amount of Rs.46.35 crores as earnest mone, however the amount is disputed by learned Additional Solicitor General appearing for the petitioner. According to the learned ASG, the earnest amount is only Rs.29.73 crores.
Mr. Kapil Sibal, learned counsel for the first respondent submits that the petitioner may appropriate the earnest amount. He further made a statement that first respondent shall pay another amount of Rupees Fifty Crores to the petitioner by 31st October, 2016 and also stated that the first respondent will come forward before this Court with a more concrete proposal regarding the payment of other amount due any date after 12th August, 2016 which this Court may fix up.
In the circumstances, we direct that this matter be listed on 22nd August, 2016. Regarding difference of the amount as regards the earnest money held by the petitioner, learned counsel appearing on either side agree to discuss the matter and make a final statement on the next date of hearing.
