UPON hearing counsel the Court made the following O R D E R

Learned counsel for the petitioners is present.

None for the respondents.

Respondent No.1 has already filed the counter affidavit, as is palpable from the perusal of the office report.

Service is complete as against the respondent No.4 but nobody has cast appearance on his behalf. The said respondent may file the counter affidavit before the next date in case he chooses to do so. Item No.81 -2-

Affidavit in proof of dasti service of respondent Nos.2 and 3 has not been filed by the learned counsel for the petitioner, despite opportunities. The matter shall, therefore, be listed before the Hon'ble Judge in Chamber for non-prosecution as against the said respondents.

Respondent No.5 is reported to be dead. Learned counsel for the petitioner is directed to take appropriate steps for bringing on record the legal representatives of the deceased respondent and in case any such application is filed,

the same shall be placed for orders before the Ld.Registrar(Judl.) supervising the working of Section XIA.
