S U P R E M E C O U R T O F I N D I A RECORD OF PROCEEDINGS

Petition for Special Leave to Appeal (C) No(s). 8378/2021

C.S. UDAYAKUMAR & ANR. Petitioner(s)

VERSUS

PALANIAMMAL & ORS. Respondent(s)

Date : 25-04-2024 This petition was called on for hearing today. CORAM :

HON'BLE MR. JUSTICE PRASANNA BHALACHANDRA VARALE [IN CHAMBERS]

  • For Petitioner(s) Mr. Ravi Raghunath, Adv. Mr. Sanyat Lodha, AOR
  • For Respondent(s) Mr. R. Nedumaran, AOR Mr. C. Aravind, Adv. Ms. Janani B, Adv.
  • Mr. Iyengar Shubharanjani Ananth, AOR
  • UPON hearing the counsel the Court made the following O R D E R

Learned counsel for the petitioners submits that an objection is raised by the Office for non supply of the spare copies. Learned counsel submits that within one week, spare copies would be supplied. On supply of the spare copies, notice be issued to the legal representatives of deceased respondent Nos. 1, 4 and 6.

In so far as the other objection raised by the Office namely not taking steps in respect of deceased respondent No.2, learned counsel invites my attention to the statement made in the special leave petition

at Para '1A' and it reads:-

"The petitioner submits that the Respondent No.2 passed away during the pendency of A.S. No. 784 of 2012 before the Hon'ble High Court and her Legal Representatives were impleaded as Respondents No.9 to 11 before the Hon'ble High Court and therefore they are once again arrayed as Respondents No.9 to 11 before this Hon'ble Court."

It is also an admitted fact that learned counsel submits that respondent Nos.9 to 11 are are being represented by the counsel and have also filed their response to the petition.

As such, Office objection to that effect is waived.
