THE STATE OF ORISSA Petitioner(s)

VERSUS

DHARMENDRA SAHA Respondent(s)

IA No. 69014/2020 - CONDONATION OF DELAY IN FILING)

Date : 15-12-2021 These matters were called on for hearing today. CORAM :

HON'BLE MR. JUSTICE SANJAY KISHAN KAUL HON'BLE MR. JUSTICE M.M. SUNDRESH

For Petitioner(s) Mr. Nikhil Majithia, Adv. Mr. Anirudh Anganeria, Adv. Mr. Raghavendra P. Shankar, Adv. Mr. A.K. Sharma, AOR Mr. B.V. Balaram Das, Adv.

For Respondent(s)

UPON hearing the counsel the Court made the following O R D E R

Delay condoned in terms of order dated 28.10.2021.

We may not agree with the view taken in the impugned order but with the passage of time of 2½ years and there being apparently no other material against the respondent of his activities during this period of time and six out of the eight witnesses having being examined on behalf of the prosecution, we are of the view that no purpose would be served by interfering with the impugned order.

The special leave petition is dismissed in terms aforesaid.
