The office report on default was listed before the Hon'ble Court (In Chamber) on 09.11.2016, when the Court was pleased to pass the following order :

" It has been stated by learned counsel for the petitioner that respondent Nos. 5 and 18 have died and he will take steps for bringing on record the LRs. of the said deceased respondents. He is permitted to do so.

So far as filing of proof of dasti service in respect of respondents 3, 12 and 15 are concerned, he prays for and is granted two weeks' time to file proof of dasti service."

It is submitted that counsel for the petitioner has on 3rd January filed affidavit of dasti service in respect of R3 and 12 stating therein that service is complete on R3 and 12 but he has not filed proof of service.

It is further submitted that counsel for the petitioner has on 312017 given fresh address of R15 in the affidavit of dasti service stating therein that notice required to be issued to R15 on the fresh address.

It is also submitted counsel for the petitioner has on 312017 also filed an application for substitution to bring on record the legal representatives of deceased Respondent No. 5 and 18 along with application for condonation of delay in filing substitution and setting aside abatement application but the same is defective for the reason that averments para 'there is no other LRs.....' has not been given in the application for substitution and the application is barred by time by 41 days.

The office report for direction in matter abovementioned is listed before the Hon'ble Court (In Chamber).
