UPON hearing the counsel the Court made the following O R D E R

Issue notice limited to the question as to whether the dissolution of marriage between the parties can be ordered in exercise of power under Article 142 of the Constitution of India, in view of the long separation and taking note of the submission by the learned counsel for the petitioner that the petitioner has remarried and that a child is born.

Notice will be issued only upon the petitioner depositing a sum of Rs.75,000/- with the Registry of this Court towards the litigation expenses of the respondent. Upon deposit and upon notice being issued and on the respondent appearing in the matter, it will be open to the respondent to withdraw the said amount.
