UPON hearing the counsel the Court made the following O R D E R

W.P.(C) No. 69/2018

In the said petition, the Ld. Counsel for the petitioner submitted that service is already complete qua all the respondents. Respondent Nos.3 and 4 have filed counter affidavit. Three weeks' time has already been granted by the Hon'ble Court to respondent No.2 for filing counter affidavit. No counter affidavit has been filed by them. The Ld. Counsel requested that the matter may be listed before the Hon'ble Court.

However, the Ld. Counsel for respondent No.2 in this matter submitted that he did not appear on the date of the passing such order. He has filed vakalatnama only on 6.7.2018. He further submitted that complete set of pleadings has yet not been served upon him. The Ld. Counsel for the petitioner is directed to serve complete set of pleadings within one week and file proof thereof. The Ld. Counsel for respondent No.2 to file counter affidavit within four weeks thereafter.

Service is complete on respondent No.1. The Ld. Advocate, Mr. Deepak Tyagi, appearing on behalf of Ms. Anil Katiyar, Advocate-on-record appears for respondent No.1. He seeks time to file vakalatnama and counter affidavit. Be filed within four weeks.
