UPON hearing the counsel the Court made the following O R D E R

SLP (C) No. 3643/2023

This petition filed under Article 136 of the

Constitution of India arises from a PIL filed by the petitioner in the High Court when the petitioner is not even an aggrieved party. Before this Court, the SLP has been adjourned without issuance of notice on repeated requests being made. Today also, none appears for the petitioner.

The special leave petition is, accordingly, dismissed.

However, this will not in any manner prejudice the rights of the affected parties as we have issued notice in SLP(C) D. No. 39669/2022.

D. No. 39669/2022

Permission to file SLPs. is granted.

Delay condoned.

Learned counsel for the petitioners seeks to assail Section 3 of the Validation Act seeking to validate the selection of 2011 batch of Gazetted Probationers, despite the observations made in respect of the same by the High Court and affirmed by this Court.

Issue notice, returnable on 16.10.2023.

Dasti service, in addition, is permitted.
