Despite repeated adjournments granted in these matters to enable the parties to move the High Court for early disposal of pending writ petitions/writ appeals, referred to in the affidavit, filed on 02.07.2021 by the Collector, it appears that the parties have not taken any steps to mention the matters before Chief Justice of the High Court of Madras for taking up the pending writ petitions/writ appeals together before one Bench expeditiously in view of liberty granted by this Court on 10.08.2021. Admittedly, the stated writ petitions/writ appeals have been filed to assail the order passed by the Collector being the fall out of the direction given by this Court vide order dated 22.07.2021.

In one sense, the claim of the parties in writ petitions/writ appeals pending before the High Court is overlapping with the issues that may have to be answered in the present proceedings pending before this Court, concerning the same subject matter and between the same parties.

In the circumstances, in the interest of justice, we deem it appropriate that all issues are answered by this Court in proceedings pending in this Court, including regarding the challenge set up in the writ petitions/writ appeals pending before the High Court.

Accordingly, we direct that the writ petitions/writ appeals being W.P. Nos. 4919, 4922, 5057, 5058, 4761, 4762, 4763, 4764, 4765, 5747, 5748, 5913, 4923, 4920, 4824, 5056, 5054, 5060, 4760, 4921, 5055, 5059 and 9406 of 2011, 23361 and

29633 of 2013, 9420 of 2015 and 19262 of 2021 and W.A. Nos. 231 and 394 of 2011 pending before the High Court of Madras shall stand withdrawn to this Court, to be heard alongwith the group of cases mentioned earlier. We order accordingly.

The Registry to take steps to call for the papers/record pending before the High Court of Madras in connection with this group of cases forthwith.

List these matters alongwith transferred cases on 02.05.2022.

The Registry may take steps for transfer of record through electronic mode or by requesting the High Court to depute Special Messenger for delivery of record, so that this Court may proceed with the matter appropriately on the next date of hearing.

Copy of this order be forwarded forthwith to the Registrar General of High Court of Madras for information and necessary action through email.

The interim protection given to the occupants' structures standing on the disputed land to continue on the same terms till the next date.
