CIVIL APPEAL No.2453/07
It is submitted that there are four respondents in this appeal. All the respondents are represented by their respective advocates.
It is further submitted that Mr. V. N. Raghupathy, Advocate has on 21.10.2011 filed counter affidavit in I.A. No. 11 and he has on 03.01.2013 filed an application for taking on record additional documents. Copies of the same have been placed with appeal Paper Books.
It is also submitted that Mr. Ajit S. Bhasma, Advocate has on 4.2.2011 filed an application for recall/modification and restoration of Court's Order dated 18.10.2011 passed in I.A. No. 13/2009 (registered as I.A. No. 14). Copy of the same has been placed with I.A. No. 13 Paper Books.
It is lastly submitted that Mr. V. G. Pragasan, Advocate has on 10.1.2012 filed an application for revocation with affidavit, Mr. B. Balaji, Advocate has on 21.3.2012 filed an application for directions on behalf of State of Tamil Nadu and Mr. V. N. Raghupathy, Advocate has on 23.1.2013 filed an application for urgent directions of early listing of the Civil Appeal. All I.As. have been registered as 15 to 17 and copies of the same have been placed with appeal Paper Books.
CIVIL APPEAL No.2456/07
It is submitted that there are three respondents in this appeal and all are represented by their respective advocates. It is further submitted that Mr. B. Balaji, Advocate has on 17.4.2012 filed application for directions (registered as I.A. No. 4) and the same has been placed with appeal Paper Books.
It is also submitted that I.A. No. 7 filed by Mr. B. Balaji, Advocate on 11.11.2013 was listed before the Hon'ble Court on 03.12.2013 when the Court was pleased to pass the following Order:-
"We do not think that there is any urgency for consideration of the prayers made by the applicant/appellant – State of Tamil Nadu by means of this application.
In our view, the application can wait and may be heard along with the Civil Appeal.
List Interlocutory Application No. 7 of 2013 along with Civil Appeal.
The respondents, State of Karnataka as well as Union of India, may file their response to Interlocutory Application No. 7 of 2013 within four weeks."
Copy of I.A. Nos. 6 & 7 have been placed with appeal paper books.
It is further submitted that Counsel for the Respondent No.1 has on 04.01.2014 filed an affidavit in IA No. 7 and others have not filed reply, so far. Counsel for the appellant has on 06.01.2014 filed list of events. Copies of the same have been placed with appeal paper books.
It is also submitted that Counsel for the appellant has on 25/6/2013 filed Contempt Petition (Civil) alongwith "Annexure A to I" with Vakalatnama and memo of appearance in the matter above mentioned, registered as Contempt Petition(Civil) No.225/2013. Copy of the same has been placed with I.A. paper books for kind perusal of the Hon'ble Court.
It is lastly submitted that the instant appeal has been tagged with Civil Appeal No. 2453 of 2007 (Main matter). Instead of sending Original records in the said appeals, letter dated 22.6.2009 has been received from Cauvery Water Disputes Tribunal, Govt. of India, Ministry of Water resources stating therein that Original Record consists of statement of cases, counter affidavits and rejoinders followed by evidence and final arguments which run into thousands of pages. Civil Appeal No. 2454/2007 is related with the Section XII.
The appeals above mentioned are listed before the Hon'ble Court with this office report.
